Trademark, Copyright and False Advertising

Kaye Scholer represents clients in all areas of trademark, copyright and false advertising law, including litigation and counseling. MEHR

Our unfair competition and trademark practice extends back to the 1930s and our attorneys come from diverse backgrounds, with broad experience in all areas of trademark, copyright and unfair competition law, as well as antitrust law and litigation, and U.S. Patent & Trademark Office and U.S. Copyright Office proceedings.

We have litigated major trademark, trade dress, counterfeiting, cybersquatting, copyright, false advertising and unfair competition matters, in addition to consumer fraud class actions, for leading companies in a wide range of industries, including food, pharmaceuticals, office products, liquor, television programming, film, music, cosmetics, publishing, toys, apparel and luggage. Our attorneys have the experience and skills to efficiently handle all types of trademark, copyright, false advertising and related cases and consultations.

The Trademark, Copyright and False Advertising Group has the demonstrated ability to quickly and efficiently prepare TRO and preliminary injunction papers and conduct expedited discovery, understand and present complex scientific evidence relating to false advertising and other claims, devise and conduct sophisticated, aggressive and novel defenses to putative consumer class actions and provide informed advice regarding the substantiation of proposed advertising claims, the clearance of proposed trademarks, and the defensibility of potential and actual intellectual property claims. It has particularly extensive experience in the design and use of expert surveys in false advertising and trademark litigations and consumer fraud class actions.

Our practice works regularly with Kaye Scholer's Entertainment and Media Law Practice Group on matters relating to intellectual property rights in the entertainment and media industries. We also work closely with the firm's Technology, Intellectual Property and Outsourcing Group, which has extensive experience in the protection of intellectual property, including in technology transactions, outsourcing and other e-commerce matters.
