Taryn Lam has extensive intellectual property litigation experience. She focuses primarily on patent litigation involving a variety of technologies, including computer software and hardware, Internet applications, computer networking, and entertainment software. She has litigated and favorably settled patent cases in the Northern District of California, Eastern District of Texas, and Northern District of Illinois, as well as copyright, trade secret and contract cases in California state courts.

Ms. Lam was part of a litigation team that won summary judgment based on a novel interpretation of the scope of California’s trade secret laws as applied to computer software. The judgment, which was subsequently relied upon by the other co-defendants, was affirmed on appeal. See Silvaco Data Systems v. Cirrus Logic, Inc., 2010 WL 1718112 (Cal. Ct. App. April 29, 2010). She has drafted a variety of successful motions, including motions to dismiss, motions to stay litigation pending reexamination, discovery motions and summary judgment motions, and has argued and second-chaired numerous motion hearings. She is also experienced in all phases of the discovery process, including taking and defending depositions, and drafting and responding to written discovery. She is involved in day-to-day case management, client counseling, and retaining and working with experts. Ms. Lam previously served as the Vice-Chair of the American Bar Association’s Task Force on Biometrics and has co-authored The Practitioner’s Guide to Biometrics.

Representative Patent Litigation Experience

SP Technologies, LLC v. HTC Corp. et. al.
Represented HTC in patent litigation in the Northern District of Illinois involving touchscreen input technology. Won motion to stay pending reexamination and favorably settled the case.

HTC Corp. et. al. v. Technology Property Ltd. et. al.
Represented HTC in patent litigation involving microprocessors.

Marvell Semiconductor, Inc. et. al. v. Commonwealth Scientific and Industrial Research Organisation
Represented Marvell in high-stakes patent litigation involving wireless local area network technology.

Taiwan Semiconductor Manufacturing Corporation (TSMC) v. Semiconductor Manufacturing International Corporation (SMIC)
Represented TSMC in patent infringement and trade secret misappropriation Section 337 investigation before International Trade Commission (ITC). The resulting settlement amount in favor of the firm’s client, $175 million, was one of the highest in recent ITC history.

M-Systems, Inc. et al. v. Trek 2000 International, Ltd (Singapore)
Represented Trek 2000 International in patent infringement litigation in Singapore involving a USB portable memory device.

Representative Copyright Litigation Experience

DocMagic, Inc. v. Ellie Mae, Inc.
Represented Ellie Mae, Inc. in parallel state and federal court actions involving mortgage loan document preparation software and concerning antitrust, copyright, and breach of contract claims.

EnReach Technology, Inc. v. Embedded Internet Solutions, Inc. et. al.
Represented Cirrus Logic in copyright infringement lawsuit involving Internet browser software. Won summary adjudication on three of four causes of action and favorably settled remaining cause of action.

DVD CCA v. Kaleidescape, Inc.
Represented DVD Copy Control Association in a breach of license case relating to home DVD entertainment systems.

Representative Trade Secret Experience

Silvaco Data Systems v. Cirrus Logic, Inc.
Represented Cirrus Logic in a trade secret lawsuit involving Electronic Design Automation technology. Successfully defeated three causes of action via motion for judgment on the pleadings and won summary judgment on remaining trade secret misappropriation claim.
