Jessica Malkin is an Associate in the Litigation Department of Kaye Scholer’s New York office. Her practice focuses on complex commercial litigation and mass-tort pharmaceutical product liability litigation. Jessica has extensive experience in all phases of the state and federal court litigation process, including motion practice, expert retention and preparation, discovery, trial preparation and trial, alternative dispute resolution, appellate work, and end-game/settlement analysis. Her clients include major U.S. and international corporations, individual clients, and charitable trusts, and private equity funds. Additionally, she has assisted individuals and businesses in responding to a variety of civil and criminal government inquiries from various regulatory and enforcement agencies, including the Securities and Exchange Commission and the Department of Justice.

Jessica is an active participant in the firm’s pro bono program and is a recipient of Kaye Scholer’s Pro Bono Award (2005-2011). She is a Trustee of the New York University School of Law Foundation Board, a Director of the Filomen M. D’Agostino Foundation and the Claire, Meyer and LeeAnn Frank Foundation.

Representative Matters

  • Served as second chair trial counsel for U.S. licensee of well-known children’s television entertainment property, obtaining favorable decision after three week trial in bankruptcy court that the client’s license was wrongfully terminated.

  • Representation in connection with alleged securities fraud involving sovereign debt instruments.

  • Representation of a multi-million dollar charitable trust and its trustees in a civil RICO action alleging unfounded claims of fraud.

  • Representation of AstraZeneca in thousands of product liability lawsuits alleging that its atypical antipsychotic drug, Seroquel, causes diabetes and related injuries. Ms. Malkin was responsible for preparing company witnesses for deposition and trial and assisted in the strategic end game/settlement analysis that contributed to the successful resolution of the litigation.

  • Representation of Novartis Consumer Health, Inc. in three jury trials in connection with plaintiffs who claimed injuries from products containing PPA. Obtained two defense verdicts in New Jersey state courts and a hung jury in Arizona federal court.
