Jay W. Waks Win Dismissal of Discrimination Claims

The City of New York's Commission on Human Rights recently issued a decision and order in which claims that were brought against our client, a large consumer electronics company, were dismissed on the merits following a comprehensive investigation. Jay Waks, partner in the Litigation Department and Chair of the Employment & Labor Law Practice, successfully represented our client against a current employee claiming racial and disability discrimination. The claims involved allegations of a failure to promote and retaliation for threatening termination based on poor work performance. The same employee previously had filed a complaint of religious discrimination with the New York State Human Rights Division, alleging a failure to accommodate his Sabbath observance. Although our client initially had been represented by another firm, Kaye Scholer was substituted as counsel, and our team was able to negotiate a no-cost settlement, resulting in voluntary dismissal of the NYS HRD complaint with prejudice.
