Former DOJ Attorney Philip Giordano Joins Kaye Scholer as Antitrust Counsel in DC and Palo Alto

Palo Alto/Washington, DC: Philip Giordano has joined Kaye Scholer as Counsel in the firm’s Antitrust Practice. He will split his time between the firm’s Washington, DC and Palo Alto offices.

Giordano most recently served as a Trial Attorney in the National Criminal Enforcement Section of the Department of Justice, Antitrust Division, where he focused on the investigation, development and resolution of civil and criminal antitrust cases and the legal analysis of complex antitrust and federal criminal law issues. Significant matters include obtaining a $45.8 million criminal fine in auto parts case U.S. v. Panasonic Corp. (E.D.MI. 2013), as well as leading criminal investigations into three other auto parts manufacturers as part of the Antitrust Division’s ongoing prosecution of international auto parts cartels.

Before moving to the National Criminal Enforcement Section, Giordano served as Special Assistant to the Directors of Enforcement in the Antitrust Division’s Office of Operations. He also served as a Trial Attorney in the Networks & Technology Enforcement Section. During his tenure at the Antitrust Division, Giordano has handled a wide variety of enforcement matters, including criminal, civil non-merger and merger-related matters, and received the Attorney General’s Distinguished Service Award for the enforcement of the final judgment in United States v. Microsoft (D.D.C. 1998).

Giordano has considerable experience in a wide range of industries, including technology, financial services, automotive parts and consumer goods. Prior to his government service, he served as Chief Technology Counsel at Baan Software Corporation, where he served as first chair in alternative dispute resolution proceedings, negotiated multi-million dollar software contracts and licenses and settled contract disputes.

Giordano is a frequent presenter and guest lecturer on issues related to criminal cartel enforcement and other antitrust topics. A graduate of Stanford Law School, he also holds a BA in Quantitative Economics and a BS in General Engineering from Stanford University. Admitted to the California State Bar, he is also licensed to practice before the US Supreme Court and the US Ninth Circuit Court of Appeals.
