Compliance Berater Publishes Jungermann Article
on Antitrust Follow-On Issues
The prominent German law magazine Compliance Berater published Frankfurt-based Antitrust partner Sebastian Jungermann’s article on the German Federal Supreme Court’s recent landmark antitrust damages follow-on decision. Among other issues, the court’s July 12, 2016 decision (KZR 25/14 – Lottoblock II) dealt with the extent to which the determination of antitrust infringement in a cartel administration proceeding should be binding, in case damages are sought for this offense in a later follow-on action, and what requirements should be set at the detection of a defect.
