New Measures Issued to Regulate Land Use for Construction Projects

On November 29, 2008, the Ministry of Land and Resources ("MLR") released the revised Administrative Measures for Preliminary Examination of Land Used for Construction Projects (the "Measures"), effective January 1, 2009. Construction projects shall be approved, ratified by or filed for record with the construction bureaus before being carried out. The Measures also provide in detail the documents required for the pre-examination of such projects. In conducting the pre-examination, the land bureau shall also determine whether the construction projects comply with the national policy for supplying land, requirement over the quota of construction land, and compensation for expropriation of the land and other related matters. The official opinion issued upon the pre-examination is necessary for obtaining approval of a construction project and such approval will not be granted if the applicant fails to go through or pass the pre-examination.
