China to Further Strengthen the Administration of Technology Exports
The Ministry of Commerce, together with the
Ministry of Science and Technology, released the amended Administrative
Measures on Prohibited and Restricted Export of Technologies (the "Amended
Measures") on April 20, 2009. According
to the Amended Measures, any restricted technology export is subject to
approval by the local administration of commerce, and such approval is valid
for three years. Upon receiving such
approval, the exporting party is required to enter into an exporting agreement
with the applicable purchaser, and file such agreement with the same
approval authority within the applicable three-year period to apply for final
approval and a certificate. Such final
approval and certificate are required for customs clearance of the exported
technology.
