Supreme Court Strikes Blow to Class Actions of Arbitrable Disputes

Summary:  In a significant decision expanding the enforceability of arbitration clauses in consumer contracts, the United States Supreme Court has dramatically expanded the opportunity for businesses to compel arbitration of claims by consumers and potentially of employees (In AT&T Mobility LLC v. Concepcion, 2011 U.S. LEXIS 3367 (April 27, 2011)). The attached Client Alert analyzes the Court’s decisions and its far-reaching implications.
