The Deal examined a 2010 takeover by Hong Kong-based investors into Nevada gold mining company Nevada Gold Holdings Inc., now facing a Treasury Department investigation. The investigation by the Committee on Foreign Investment in the United States (CFIUS) indicates that CFIUS is considering recommending that controlling stakeholder Far East Golden Resources Group Ltd. be forced to divest the mining exploration company.
According to Kaye Scholer Partner Farhad Jalinous, who focuses on National Security and CFIUS reviews, “That CFIUS is taking these steps so long after the deal was consummated is a bad sign for the company.”
“If the government comes back almost two years later and says make a CFIUS filing, that’s not good news,” he added.
