In addition to handling litigation in the United States, our lawyers have assisted in foreign counterpart litigations by coordinating positions, contributing to briefs and affidavits, preparing witnesses, and assisting foreign counsel at trials and hearings, (including in countries throughout Europe, Canada, Australia, Israel and China) and in proceedings in the European Patent Office. The group routinely provides clients with strategic advice during the research and development phases of product development, peer reviews of important patent prosecutions and due diligence reviews of target company products, patents and technology-related agreements. The group also counsels clients on and negotiates licensing arrangements and technology joint ventures. Our patent litigators recently authored the Kaye Scholer Deskbook on Pharmaceutical and Biotech Patent Law (PLI).

Consisting of more than 60 lawyers who combine the firm's high trial and litigation standards with the deep understanding of patent law, science and engineering, Kaye Scholer handles major patent, contract, and trade secret cases involving a variety of technologies, with a special emphasis on medical devices, pharmaceuticals, chemicals and manufacturing. With a primary focus on trial and litigation capability, much of the group's work on behalf of clients concerns blockbuster products. At trial, we present the complex technology and patent concepts to the court and jury in the simplest form and in the context of familiar themes and a compelling story. During pretrial, we stress efficient and productive discovery and, where possible, an early disposition of the issues by summary judgment or tactical settlement.
