Manuel Kushner has extensive litigation trial and appellate experience, especially in complex commercial matters. With more than thirty years’ experience, Manuel has handled virtually all types of civil, commercial matters, including such real estate-related disputes as mortgage foreclosures, title controversies, construction defect and delay claims, and landlord-tenant proceedings; such business-related disputes as breach-of-contract actions, franchise claims, enforcement of non-compete agreements, securities violations, theft of trade secrets, trademark infringement, and tortious interference claims; and such specialized areas as bankruptcy, probate litigation, all manner of commercial fraud, lender liability and shareholder derivative claims.

James D. Herschlein (06/10/14)

James D. Herschlein serves as Co-Chair of the Complex Commercial Litigation Department and recently completed two terms as a member of the firm’s Executive Committee. He has represented some of the world’s largest companies in numerous trials, arbitrations, mediations and appeals throughout the United States, focusing on complex contractual disputes and product liability litigation. Jim’s trial experience also includes cases involving securities, derivatives, intellectual property, real estate and bankruptcy claims.

Robert A. Kandel (03/28/14)

Robert A. Kandel, former Commissioner of New York City’s Office for Economic Development and representative of Mayor Koch on the New York City Board of Estimate, joined the Kaye Scholer Real Estate Department in 1989 to represent clients in the areas of real estate development, zoning, land use regulation, public economic development incentives and tax assessment reductions.

Julius Berman (03/28/14)

Julius Berman has been involved in the Litigation, Antitrust  and Real Estate Practices for more than over 30 years. In real estate litigation, Mr. Berman has successfully handled construction litigation, major lease disputes and brokerage disputes, among others.  He has also  counseled major developers and large commercial landlords.

H. Peter Haveles, Jr. (03/24/14)

Peter Haveles, a Partner in the Complex Commercial Litigation Department, focuses his practice on complex disputes involving the financial markets and commercial transactions. Over the course of his career, Peter has developed an extensive understanding of his clients’ business operations, the financial markets in which they operate and the risks that accompany them. Based on that knowledge and experience, he has advised clients with respect to litigation risks for numerous transactions and litigation arising from those transactions. In addition, Peter actively counsels clients of the firm in these areas to minimize the litigation risks associated with their businesses, and to resolve disputes as efficiently and effectively as possible. He has been recognized as a “Litigation Star” by Benchmark Litigation from 2012 through 2014.

Danelco Moxey (03/21/14)

Danelco (DC) Moxey is an Associate in the Complex Commercial Litigation Department of the firm’s New York office. DC primarily focuses his practice on complex commercial disputes, financial services litigation, securities and regulatory enforcement matters and civil class actions. He represents clients in state and federal litigation throughout the United States, and his work spans many industries, including pharmaceuticals, real estate, computer software and hardware, financial services and manufacturing. He has experience representing major international financial institutions, asset management firms and a variety of other companies in a wide range of matters.
