Emily Newhouse Dillingham is an Associate in Kaye Scholer’s Litigation Department. Her practice focuses on complex commercial litigation, with an emphasis on white collar criminal defense, internal and government investigations and trade secret matters. Emily has experience with all phases of litigation, including managing all stages of discovery, taking and defending depositions, authoring and arguing dispositive motions and representing clients at trial and in settlement discussions.

Emily is an adjunct professor at Northwestern University School of Law. She graduated with a BA in English Literature, with distinction, from the University of Virginia in 2001 and received her JD, cum laude, from Northwestern University School of Law in 2006, where she served as the Membership Editor of the Northwestern University Law Review.

After graduation from Northwestern, Emily clerked for the Honorable Robert W. Gettleman in the United States District Court for the Northern District of Illinois (2006-2008). Prior to law school, she spent two years working in the Federal Trade Commission’s Office of General Counsel, where she focused on analysis of antitrust and consumer protection legislation.

Emily is a member of the Illinois Bar and is admitted to practice before the Seventh Circuit and Northern and Central Districts of Illinois. She is a member of the American and Chicago Bar Associations.

Select Representative Matters

  • Represented a manufacturer in class actions alleging fraudulent marketing and advertising of smartphones.

  • Represented a Korean textile manufacturer in trade secret litigation at district and appellate court levels.

  • Assisted in negotiating a successful settlement for an energy exploration company in a breach of contract action regarding management of drilling operations.

  • Achieved dismissal of consumer fraud claims on behalf of a physical therapy chain.

  • Negotiated numerous favorable settlements for clients with the Equal Employment Opportunity Commission and the Illinois Department of Human Rights.

  • Served as a member of the trial team for a major airline in a Chapter 11 proceeding seeking rejection of the company’s collective bargaining agreements.

  • Served as a member of the litigation team for a debtor in a Chapter 11 restructuring proceeding.

  • Co-authored numerous petitions for certiorari filed with the US Supreme Court.
