David Hibey concentrates his practice in the areas of trial and appellate litigation, government contracts counseling and litigation, and export control compliance.

Mr. Hibey’s background includes vast first-chair trial and appellate experience involving breach of government contract claims, bid protests, commercial lease and concession disputes, claims arising under Fair Labor Standards Act, cost accounting, and construction matters. Mr. Hibey has appeared numerous times for oral arguments before the United States Court of Appeals for the Federal Circuit, the United States Court of Federal Claims, and the United States Court of International Trade. Mr. Hibey also has experience appearing before suspension and debarment officials at the Department of the Army, as well as investigators with the National Transportation Safety Board, the Department of Transportation, Office of Oil Pipeline Safety, and the Securities and Exchange Commission.

Mr. Hibey’s background also includes conducting corporate investigations involving securities, pharmaceutical, transportation, antitrust, and government contract matters. In connection with these and other matters, Mr. Hibey conducted detailed witness interviews, and prepared investigative reports. Mr. Hibey has also prepared and accompanied witnesses for testimony before the SEC and the Office of Oil Pipeline Safety, as well as representing parties at proffers session with government prosecutors.

In addition to working several years in private practice, Mr. Hibey served as a Trial Attorney for the United States Department of Justice in the Department's Commercial Litigation Branch in Washington, DC, where he represented the United States in commercial litigation matters before the United States Court of Appeals for the Federal Circuit, the United States Court of Federal Claims, the United States Court of International Trade and in cases involving various boards of contract appeals.
