Patricia Carson Spoke at Intellectual Property Owners Association's Webinar on Current Topics in IP

Patricia A. Carson, Partner in the Patent Litigation Department, spoke at the Intellectual Property Owners Association’s webinar “Patent Term Adjustment: The Next Chapter from Novartis” on August 5, 2010. The webinar discussed Wyeth v. Kappos and the potential issues raised by Novartis’ recent suit in the U.S. District Court of the District of Columbia seeking review of the USPTO’s patent term adjustment determinations for eleven Novartis patents. Ms. Carson was lead counsel in Wyeth v. Kappos, where she prevailed on behalf of Wyeth (now Pfizer) and Elan at the district court and at the Federal Circuit, successfully challenging the USPTO’s interpretation of the statute designed to compensate patent holders for loss of patent term due to delays in processing applications. Other panel members included the patent prosecutor who first discovered a separate calculation error by the USPTO and a patent expert with extensive experience at the USPTO.External Link: For more information on the webinar, please click here.
