Kaye Scholer Successfully Defends Lower Court Victory at the Federal Circuit

Kaye Scholer LLP has successfully defended a district court victory at the United States Court of Appeals for the Federal Circuit in a patent infringement case for client Comdata Stored Value Solutions, Inc. On April 30, 2009, the Federal Circuit affirmed the decision of the United States District Court for the Middle District of Florida, which had entered judgment in favor of Comdata and three other gift card companies in a patent infringement suit brought by the plaintiff Every Penny Counts, Inc. In affirming the district court, the Federal Circuit agreed that the patent-in-suit could not be construed to cover the purchase of a gift card.

Alan M. Fisch (Partner, Litigation, Washington Office) argued the appeal and was joined on the brief by team members Jason Hoffman, Coke Morgan Stewart (both Counsel, Litigation, Washington Office), and Bill Sigler (Litigation, Washington Office). This is the third Federal Circuit victory for Alan and his team in the last ten months.
