Richard Smolev has broad insolvency experience at all levels of the capital structure in a variety of industries. He has particular experience with the insolvency aspects of leveraged and operating leases, and routinely works with the firm’s structured finance and real estate securitization practice groups in their financing and capital market transactions. A number of his clients actively participate in the distressed loan and bond markets, and draw on Mr. Smolev’s cross-border experience to buy companies across the globe.

Jonathan Agudelo is an Associate in the Bankruptcy and Restructuring Department in the New York office of Kaye Scholer. He has represented secured and unsecured creditors in Chapter 11 reorganization and liquidation cases and out of court restructurings in various industries, including media, aviation, commercial real estate and energy. Mr. Agudelo has had experience in plan drafting and in all phases of bankruptcy litigation, including discovery practice, mediation, examiner investigations, depositions, and hearings on contested plans.

David von Saucken is a Partner in the Bankruptcy & Restructuring Department of Kaye Scholer’s London and Frankfurt offices. David focuses on solvent or insolvent restructuring of businesses and liabilities as well as distressed investing. David has ample experience in advising funds and investment banks in corporate special situations both in Europe and Emerging Markets and has also often worked on CMBS and other complex real estate-related restructurings. She has a broad range of experience representing syndicate agents and individual lenders in out-of-court restructurings and liquidations, Chapter 11 cases and cross-border insolvency matters and is known for her hands-on approach in dealing with such large credit interests as well as middle market matters.
