Saul Morgenstern, Co-Chair of the firm’s Antitrust practice, litigates complex disputes, class actions and multi-jurisdictional cases before US federal and state courts, international arbitral tribunals, the Federal Trade Commission and the US International Trade Commission, and represents clients in US Government, State and foreign investigations. Claudia Higgins joined Kaye Scholer following over two decades of distinguished service as an antitrust litigator with the Federal Trade Commission (FTC). An antitrust partner in the firm’s Complex Commercial Litigation department, Claudia represents Fortune 500 companies in significant antitrust matters, particularly high-profile mergers, acquisitions and joint ventures, as well as in private antitrust litigation and civil investigations by the FTC, the US Department of Justice (DOJ), and numerous international regulatory agencies. Her experience in antitrust matters spans a widely diverse set of industries, including consumer goods, defense and aerospace, natural resources, technology and health care.

Michael A. Rogoff (08/19/14)

Michael Rogoff, Co-Chair of Kaye Scholer’s Complex Commercial Litigation Department and Chair of the White Collar Litigation and Internal Investigations Practice Group, is an experienced trial and appellate lawyer whose practice is concentrated in the areas of white collar and civil litigation. He has represented major US and international corporations, as well as corporate directors and individuals, in a wide variety of disputes involving health care, securities, product liability, antitrust, consumer class action, trademark and copyright, trade secrets and breach of contract. Michael is also experienced in conducting internal investigations, as well as representing clients in SEC and grand jury investigations. He is a co-author of the Kaye Scholer LLP Deskbook on Internal Investigations, Corporate Compliance and White Collar Issues (Practising Law Institute 2014).

Andres Liivak is the Co-Chair of Kaye Scholer’s Life Sciences Industry Group and a Partner in the firm’s Corporate Department. Working together with the firm’s highly regarded, collaborative, multidisciplinary life sciences team, Andres helps life sciences healthcare industry clients develop comprehensive solutions and manage risk to achieve their business objectives. In his practice, Andres focuses on putting in place new deals as well as counseling with respect to and renegotiating existing transactions, including:

  • Priority, high value deals – examples include in-licenses of blockbuster drugs; acquisitions of target companies and products, including with sales force; divestures of approved products together with supply chain transition; collaborative development and commercialization license arrangements; contentious renegotiation of major commercial contracts relating to key products; and settlement of major IP and contract litigation with business deals.
  • Deals outside a client's comfort zone or recent experience – examples include co-promotion arrangements and companion diagnostic deals.
  • Unusually complex, novel deals – some recent examples include multi-party, multi-product collaborations involving co-development, co-commercialization and exclusive supply arrangements.
