Eric P. Marcus (03/03/14)
Eric Marcus is a Partner in the Finance Department of Kaye Scholer’s New York office and a member of the Structured Finance Practice. Eric represents US and international banks, finance companies and other financial institutions in both structured finance transactions and a wide variety of commercial lending transactions, including trade finance and vendor finance programs. In the structured finance area, Eric has set up multi-seller and single-seller asset-backed commercial paper programs, and has experience with many different types of receivables purchase transactions, including trade receivables, auto and equipment loans and leases, dealer floorplan contracts, credit card receivables, franchise loans, commercial loans, and healthcare receivables. He also regularly represents liquidity and credit enhancement providers in securitization transactions. In the commercial finance area, Eric handles asset-based loans, acquisition and leveraged buyout loans, letter of credit facilities, and participation arrangements, and is active in structuring, documenting and negotiating new financing arrangements, as well as negotiating the out-of-court restructuring of problem loans. On the borrowing side, Eric represents companies in the negotiation of their financing arrangements with banks and other lenders.

Madeleine Tan is a Partner in Kaye Scholer’s Finance group and is Co-Head of the firm’s Project Finance Practice. She has extensive experience advising investors, lenders, sponsors and underwriters in equity investments, capital markets debt offerings, tax-equity and structured finance transactions. Madeleine has been lead counsel on a broad range of transactions including project finance transactions, leveraged leases, single investor leases, capital markets offerings and privately negotiated debt instruments. She is recognized by Chambers Global 2013 as a “Foreign Expert” for USA Capital Markets Securitization and as an “Expert Based Abroad” for Australia Capital Markets.
Jonathan R.C. Arkins (02/24/14)
Jonathan Arkins is a Partner in Kaye Scholer’s Finance Department. He represents financial institutions in domestic and foreign asset-backed securitizations, supply chain financing, repurchase transactions, subscription lines and secured lending. He has extensive experience in the securitization of diverse asset types, including lottery, trade and equipment rental receivables. He also advises both US and international financial institutions on supply chain finance structures, represents banks and borrowers/sellers alike in repurchase transactions and more traditional forms of leveraged and secured lending, and has a significant practice in private equity fund financing facilities, including subscription lines, warehouse lines and other asset level financing tools. He has a particular focus on repurchase agreements and securities contracts, and regularly advises financial institutions in connection with such transactions.
