Mr. Rosenthal has extensive trial court and appellate experience in litigation involving financial services law, commercial law, constitutional law, and all aspects of administrative practice. He has presented cases on behalf of clients before the U.S. Supreme Court, most of the U.S. Circuit Courts of Appeals, and numerous federal and state trial courts throughout the United States. Among the many noteworthy cases he has handled is the successful representation of a major bank and its wholly owned brokerage subsidiary before the Supreme Court in litigation challenging its right under the National Bank Act to sell fixed and variable annuities.
Mr. Rosenthal's financial services litigation practice is quite varied in the types of organizations he represents and the types of matters handled. He has been involved in litigation with, and has advised and represented financial institutions (and their officers and directors) in investigations by federal banking regulators. He has also defended financial institutions and lenders in claims brought by consumers and regulators involving alleged unlawful lending practices, interest charges and fees.
Mr. Rosenthal has been among the most active attorneys handling supervisory goodwill litigation, personally handling some of the largest of the cases. He served on a court-appointed Plaintiffs Coordinating Committee which was charged by the U.S. Court of Federal Claims with coordinating the prosecution of over 120 cases.
Mr. Rosenthal is a member of the California, District of Columbia and Florida Bars. Mr. Rosenthal was elected to the American Law Institute in 1991 and is listed in Who's Who In America and numerous similar publications. He is a trustee and former president of Family and Child Services of Washington, DC, the area's largest comprehensive social services agency. Mr. Rosenthal has been appointed by the U.S. Court of Appeals for the DC Circuit as a member of its Advisory Committee on Procedures.
