Catherine Schumacher is a Partner in the New York office, who concentrates her practice in complex commercial litigation, securities and derivative litigation, and internal and government investigations.
全部显示Ms. Schumacher has experience representing individual directors and officers, investment banks, and issuers in federal and state courts, as well as in corporate internal and regulatory investigations. Most recently, Ms. Schumacher has represented a former member of AIG’s senior management in connection with a federal securities class action; multiple shareholder derivative suits; a federal class action brought under the ERISA statute; a fraud action brought under New York’s “Martin Act”; and in investigations before the United States Securities Exchange Commission, the Department of Justice, and the New York Attorney General’s Office.
Through such representations, Ms. Schumacher has gained significant experience in the efficient management of complex, multi-jurisdictional cases, including large-scale document review and production; extensive motion practice on complex discovery, privilege and case-dispositive issues; preparing officers and directors for depositions and appearances before the SEC, NYAG and other governmental agencies, as well as taking and defending depositions of company witnesses, experts and auditors; conducting internal witness interviews; drafting motions for summary judgment; handling appeals before the New York Appellate Division and the United States Court of Appeals for the Second Circuit; addressing directors’ and officers’ insurance coverage issues through negotiation, arbitration and litigation; participating in mediations and arbitrations to achieve successful settlements of cases; engaging in all phases of trial preparation and trials; and working with a variety of economic, insurance, regulatory and financial accounting experts on issues relating to class certification, loss causation, materiality, statistical significance, event studies and various damages’ models.
Ms. Schumacher also represented a prominent investment bank in a complex internal investigation concerning state and federal inquiries into market timing and late trading in mutual funds, and an investment research provider in an SEC investigation concerning the publication of purportedly incorrect data regarding a mutual fund in alleged violation of federal securities laws.
