Enforcement Edge: Shining Light on Government Enforcement

A cross practice team from Arnold & Porter’s Life Sciences & Healthcare Regulatory and White Collar groups has again updated our Risk & Compliance Management* chapter for U.S. law, as part of Lexology’s annual publication of Getting the Deal Through practice guides. These guides analyze key trends, opportunities, challenges, and risks in a variety of jurisdictions. In our chapter, we cover U.S. laws, regulations, and guidance relating to corporate compliance; key regulatory and enforcement bodies; important definitions, processes, and standards; areas of civil and criminal liability that companies should be aware of; and recent cases and trends, including the digital transformation. This year’s update includes a discussion of the U.S. Justice Department’s new Corporate Enforcement Policy, which sets forth incentives for cooperation with government investigations, the importance of maintaining effective compliance programs (including programs relating to text and ephemeral messaging), and a renewed focus on accountability for individual actors, among other new matters.
