InsideCounsel covered the recent Belden vs. Berk-Tek case decision over two inter partes review (IPR) appeals. The Federal Circuit unanimously agreed with the Patent Office, and on behalf of Kaye Scholer client, Berk-Tek, that two of the patents Belden held on network cables were invalid. The case is noteworthy because it was the second-ever opinion by the Federal Circuit on an IPR appeal. IPR is relatively new proceeding set up by the America Invents Act, where parties can challenge patent validity before the Patent Office’s Patent Trial and Appeal Board (PTAB).
